Terms & Conditions

I. General Provisions
The online store available at: www.oliensa.com and www.oliensa.pl is operated by Netvise Spółka z ograniczoną odpowiedzialnością with its registered office in Dzierżanowo, 06-200 Maków Mazowiecki, Dzierżanowo 8, NIP (Tax ID): 7571492715, REGON: 525265864, KRS: 0001034543, email: info@oliensa.com, phone: +48 570 021 555 (hereinafter referred to as the “Seller”).
These Terms and Conditions define the rules for using the Store, including placing orders, delivering products, making payments, withdrawing from the contract, complaint procedures, user account management, and data protection.
The Terms and Conditions constitute a standard contract template within the meaning of Articles 384 and subsequent of the Polish Civil Code.
II. Products and Their Origin
The products offered in the online Store are new, free from physical and legal defects. This statement constitutes a commitment by the Seller to deliver defect-free products to the Customer.
The products are imported from outside the EU from the manufacturer Hangzhou Comfort&Health Homeware Co., Ltd.
The importer and entity responsible for product compliance and safety on the EU market under Regulation (EU) 2023/988 (GPSR) is Netvise Sp. z o.o.
III. Placing Orders
Orders can be placed via www.oliensa.com and www.oliensa.pl.
The contract is concluded when the Customer receives an email confirming that the order has been accepted for processing.
IV. Prices and Payment
Product prices are displayed based on the user's location:

For users from Poland – in Polish zloty (PLN),

For users from EU countries – in euros (EUR).
All prices include VAT according to the regulations in the destination country and are gross prices.
The final amount payable is shown in the order summary and includes the product price and, if applicable, delivery costs.
The Store accepts the following payment methods:

Online payment or card payment via Shopify Payments – a service provided by Shopify International Limited (Ireland),

Instant bank transfer via Przelewy24 – a service provided by PayPro S.A., ul. Pastelowa 8, 60-198 Poznań,

Traditional bank transfer to the Seller’s account: mBank, account number: 48 1140 2004 0000 3902 8365 5479.
By making a payment through external payment operators, the Customer accepts the terms and conditions of the respective operator. Details are available on the websites of the respective payment providers.
For international payments made via Shopify, currency conversions are handled automatically at the operator’s rates. The Seller does not charge additional currency conversion fees.
V. Promotions and Lowest Price Information
In the case of promotions, the Seller provides information about the lowest product price from the 30 days prior to the discount.
If the product has been on sale for less than 30 days, the lowest price since the product was introduced will be indicated.
VI. Order Processing and Delivery
Order processing begins after payment is credited or – for deferred payments – after order confirmation by the Seller.
The Store delivers:

In Poland – via InPost (courier or parcel locker),

In the European Union – via FedEx.
Delivery costs depend on the destination country, weight, and chosen delivery option. Delivery costs are displayed before the Customer places the order.
The current list of countries eligible for delivery is available in the "Shipping" section on the Store’s website.
The Seller does not engage in unjustified geoblocking or discrimination based on nationality, residence, or IP address, in accordance with Regulation (EU) 2018/302.
VII. Right of Withdrawal
A Customer who is a Consumer has the right to withdraw from a distance contract without giving any reason within 14 days of receiving the product.
To exercise the right of withdrawal, the Customer should send a clear statement, e.g., via email or using the return form available on the Store’s website.
Product returns are possible through InPost parcel lockers, using the SzybkieZwroty.pl platform.
The Seller refunds payments within 14 days of receiving the returned product or proof of its return, using the same payment method the Customer used, unless the Customer agrees otherwise.
The Customer is liable for any reduction in the value of the goods resulting from handling beyond what is necessary to determine their nature, characteristics, and functioning.

Use of the form is not mandatory; a withdrawal statement may also be submitted in any other form compliant with the Consumer Rights Act of 30 May 2014.
VIII. Complaints (Product Non-Conformity)
The Seller is liable to the Consumer for the non-conformity of the goods with the contract, under Chapter 5a of the Consumer Rights Act. Liability lasts for 2 years from the date of delivery.

The complaint should include:

Customer's name and surname,

Email or postal address,

Order number,

Name of the product being complained about,

Date of the defect's discovery,
-
Description of the non-conformity,
-
Customer’s demand (e.g., repair, replacement, price reduction, withdrawal).
The Seller will respond to the complaint within 14 calendar days of receiving it and inform the Customer of the result.
If the complaint is accepted, the Seller will cover the cost of returning the product and reshipping.
If the complaint is rejected, the Customer will be informed of the reasons and the possibility of using out-of-court dispute resolution (ADR).

IX. User Account and Documentation
Customers can create a user account in the Store, enabling access to order history and faster future purchases.
Creating an account is voluntary and free of charge. Customers can delete their account at any time by sending a request to the Seller’s email.
Invoices/receipts are issued electronically. The Customer accepts the delivery of invoices to the email address provided when placing the order.
X. Reviews and Their Verification
Product reviews can only be submitted by Customers who have actually purchased the product via the Store.
Authenticity verification is performed by linking review submissions to specific order numbers. A link to submit a review is automatically sent after order fulfillment.
Reviews may be published on the product page and used for marketing purposes (e.g., on the Store’s homepage or social media).
XI. Personal Data Protection (GDPR)
The administrator of Customers' personal data is Netvise Sp. z o.o., Dzierżanowo 8, 06-200 Maków Mazowiecki, email: info@oliensa.com.
Personal data is processed for:

User account management,

Complaint and correspondence handling,

Marketing and analytics (including newsletters, remarketing),

Ensuring the security and operation of the Store.
The legal basis for processing is Article 6(1)(b), (c), or (f) of GDPR. In the case of marketing activities, it may also be the Customer’s consent (Article 6(1)(a) of GDPR).
Customers have the right to access, rectify, delete, restrict processing, transfer their data, and object to data processing.

XII. Out-of-Court Dispute Resolution (ADR)
Consumers can use out-of-court methods for dispute resolution, in particular:

Provincial Trade Inspection Authority,

European Consumer Centre (for cross-border cases).

XIII. Final Provisions
In matters not regulated by these Terms and Conditions, the following laws apply:

Regulation (EU) 2016/679 (GDPR),

Regulation (EU) 2023/988 on General Product Safety (GPSR),

Regulation (EU) 2018/302 (Geoblocking).
The Seller reserves the right to amend the Terms and Conditions in case of:

Changes in applicable law,
-
Technological or organizational changes on the Seller's side,
-
Expansion of the Store's offer or range of services.
Customers will be informed about changes at least 14 days in advance by publishing the new version on the Store’s website.
Amendments to the Terms and Conditions do not affect Customers' rights acquired before the changes come into effect.
The Terms and Conditions enter into force upon their publication on the Store’s website.
